Terms of Service

1. Agreement

These Terms govern your access to and use of the ScalezBiz website at scalezbiz.com and our software apps, including Shopify apps such as Scale-Z Barcode Importer (the "Services"). By installing an app or using the Services, you agree to these Terms. If you use the Services for a business, you confirm you have authority to bind that business.

2. The Services

We provide tools that help merchants manage product data such as barcodes. We may add, change, or discontinue features at any time. Some features may be labeled beta and are provided as-is.

3. Accounts and permissions

Apps connect to your Shopify store using permissions you approve during installation. You are responsible for your store, the accuracy of the data you upload, and for reviewing changes before you confirm them. You can revoke access at any time by uninstalling the app.

4. Plans, billing, and free trials

• Paid plans are billed through Shopify on a recurring monthly basis, at the prices shown on our Site or in the Shopify App Store.
• Plans include a monthly usage allowance (for example, a number of scans). Usage limits reset each billing cycle and unused allowance does not roll over.
• Free trials, where offered, last for the period stated at signup. You will be charged when the trial ends unless you cancel or uninstall first.
• You can cancel at any time. Cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law or Shopify's policies.
• We may change pricing with advance notice. Changes apply from your next billing cycle.

5. Acceptable use

You agree not to:

• use the Services unlawfully or to infringe others' rights;
• interfere with, overload, or attempt to gain unauthorized access to the Services or their infrastructure;
• reverse engineer, copy, resell, or sublicense the Services, except as allowed by law; or
• upload malicious code or data you have no right to use.

6. Your data

You retain ownership of your store data and content. You grant us a limited license to process it solely to provide and support the Services. Our handling of information is described in ourPrivacy Policy.

7. Intellectual property

The Services, including software, branding, and content, are owned by ScalezBiz and its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

8. Disclaimers

The Services are provided "as is" and "as available." We do not warrant that they will be uninterrupted or error-free, or that results, such as matched barcodes, will be complete or accurate. You are responsible for verifying product data before relying on it for sales, inventory, or fulfillment. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of liability

To the fullest extent permitted by law, ScalezBiz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the three months before the claim arose.

10. Indemnity

You agree to indemnify ScalezBiz against claims arising from your misuse of the Services or your violation of these Terms or applicable law.

11. Termination

You may stop using the Services at any time by uninstalling the app. We may suspend or terminate access if you breach these Terms or if required to protect the Services or others.

12. Governing law

These Terms are governed by the laws of the United States and the state in which ScalezBiz is organized, without regard to conflict-of-law rules. Disputes will be brought in the courts located there, unless the law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.
